[1] Software that is either distributed for free with no commercial licenses of any kind attached to any product that my work is involved in, or software that meets the FSF definition of Free or of which the creators are making no financial profit out in any way shape or form.
I must be contacted by a representative party for the software creators if the software is to be changed over to a commercial license or distributed for a profit by the creators or any parent company or other organization of the software's creators. A pricing arrangement shall be worked out upon contact. I reserve the right to have my works withdrawn from the product in question.
If I am not contacted by a representative before the product becomes commercial or for-profit, I shall have the right to charge my current maximum fee per model. As of this writing that fee is at $60 per model, but that number is not indicative of any future changes in that price.
Refusal to pay the given fee after 15 business days of initial attempts contact shall results in charges of theft being brought against the offending parties.
(end formal)In other words, if you are going to go commercial with a freeware project that I have donated free models too, then please contact me first! I am very willing to be understanding in these sorts of situations, and since I am not charging a per copy or per sale royalty fee of any type the cost for you will be minimal, but only if you talk to be before you release the product commercially.

[3] One or two person software teams count. If you have bought an estate in the middle of the forest for your development team to move to while programing their masterpiece, then you do not qualify.

This is another criteria that will be judged on a case by case basis.
[4] If you are not one of the big publishers (Hasbro, EA, etc), but are too large to fit under case [3], then the odds are that you fall into this category.
A Theme Pack is considered to be any collection of common objects. This collection may be custom made for you or from a preexisting theme pack that I have put together. (more on pre-existing theme packs later)
Objects falling into categories like Medieval Swords, or Space Age Weapons count as being eligible for a theme pack, as do more mundane objects such as Kitchen Utensils (silverware, dishes, bowls, and so forth).
Theme Packs naturally vary in price drastically depending on how complicated they are for me to assemble, and if I am able to use pre-existing models of mine as part of them. You may of course request completely whole and original models.
An entire collection of pots and pans may run you only a few dollars more then a single model, where as a collection of laser guns ranging from small pistols to full sized rifles will likely cost you ~$10 a model.
The basic idea behind theme packs is that I get guaranteed work and you get to save even more money. Works out good for both of us.
Have you seen the competition? Insane. Many sites will charge you over $100 for a single model.
Other sites will let you have models at similar prices to mine, after paying a few hundred dollar sign-up fee.
I can offer you my models for a great price for two reasons.
Ok so I am not technically starving, but I am not running a multi-million dollar business here, nor do I seek to ever do such. I merely wish to provide people with high quality models at an affordable price. I am also able to mainly write this entire venture off as being resume building.

As someone who was part of an independent game development team at one time I realize how expensive it can be for you to get your creative ideas up and running. Having to pay out of the ear for a 3d modeler does not help matters any.
I also retain all rights to my models. When you make a purchase from me you purchase the right to use one of my models in a single product.
This also means that I can sell preexisting models for for a minimum cost. Need a sword? No problem, I have a nice sized library of original swords that I have built up over the years. Need a custom grip on that sword? It will cost you a bit extra, but far less then any other place you will find. Other places will charge you exorbitant fees for custom models, I will charge next to nothing, if anything at all. As stated, this is the period of time in my career where I am building my resume up, my main goal is to get my models out there on the market and please my customers doing so.
And because I charge by the model and not by the hour you get a modeler at a mere fraction of the cost that it would otherwise cost you.
$15 for a custom ordered model is not bad. $10 for a model from a preexisting library is almost unheard of. $60 for a batch of models has any of you who have done price comparisons drooling right now.
I am one of but a few independent artists out there working specifically on low polygon models for FPSs. I am also one of the few 3d modelers who is willing to work closely with you in order to bring you the 3d models you need at a price that you can afford.
I retain all rights to my model. You purchase the right to use my model in a single pre-agreed upon product. If you have purchased the right to use a model under a Freeware or Non Commercial pricing plan then any changes that may effect your products Freeware or Non Commercial standing that includes the continual inclusion of one or more of my Models inside of your product shall first be negotiated with me. Failure to negotiate any potentially perceived changes in your products Freeware of Non Commercial Standing shall result in the maximum regular fee per model being charged upon you. Failure to pay this fee shall qualify you for having committed theft of intellectual and/or artistic properties.
Your purchasing of the right to use a model from me guarantees you no monopolistic or sole user rights to that model. In addition at any time I may revoke your right to use my model by returning your payment.
(end formal)In other words, you are not purchasing a model, you are purchasing the revocable right to use that model in one product that has been agreed upon by both parties (you the purchaser and myself). I can revoke that right at anytime by returning to you your money.
If the model was made under conditions by which I did not require you to pay me any money, then changing over your use of that model to being included in a product under which I would have required the payment of money, shall incur upon you to pay me the fees that would have otherwise have been paid.
Simply put, if you purchase my models while you are developing a Freeware piece of software and then you hit the big time, I merely request due payment for my works. You may of course simply withdrawal my models from your product before changing your product over to being commercial or for profit in order to not have to pay any licensing fees.
The typical exchange shall happen like this.

- You will send me a proposal indicating your interest. Please indicate what type of a project it is that the 3d models will be put in use for.
- I will contact you with either an agreement or a refusal to take up the project. I reserve the right to refuse to work on any project for any reason that I may wish.
- Payment shall either be made up of half the payment as collateral before you have received the model, and the other half after you have received the model, or as one lump sum after the model has been received. This is to be discussed between us. Payment options vary of course (I am more then willing to wait until you hit it big. :) )
- Your model will be delivered.
- ANY complaints about the quality of the model must be reported within a reasonable amount of time from you having received the model. Obviously if I have shipped to you a large quantity of models then larger allowances for time to evaluate the models shall be given, and models may of course be evaluated and rejected by you on a case by case basis. Remakes will be done free of charge if requested. If things get excessive (the definition of excessive is to be judged by me, suffice to say around the forth or fifth remake that communication difficulties will have to be evaluated. The third time through on a plasma rifle is excessive, a sword can expect to have quite a bit of minor tweaking done to it in the normal course of things) then money shall either be returned or the purchasing party shall be given their choice of which revision of the 3d model that they wish to choose for their use, at your choice.
You e-mail me, I e-mail you, payment sent in half, work done, work delivered, remaining section of payment is received.
You can of course request minor tweaks and such to a model. If you want a sword handle to be a bit larger or the blade a bit longer then I am willing to cheerfully do whatever I can to help make you happy.
If you cannot decide on the barrel length for a shotgun or I spend five or six revisions changing around the proportions of a model, then please for both of our sakes use a pad of graphing paper to get some rough estimation of how you want things to look. I have no way of knowing exactly what dimensions your world works in, and quite honestly put, remaking something beyond minor size tweaks can be a major undertaking. It is not just a simple case of using the scale command, it often times involves changing massive portions of the entire model so as to allow for the newly chosen dimensions to look natural and realistic.
This is even more true if you have specific floating point concerns (please mention them before hand!)
A reasonable number of reworkings shall be done for no extra charge of course, once again, I do want you to be happy above all else.
Upon contact, arrangements for payment can be made.
I do not currently take credit cards (sorry) but almost any other method of online payment can be arranged.
Orders that require initial creation of a new model are processed based upon a priority queue.
Commercial / Paid orders are handled on a first come first serve basis and exempt from any outstanding circumstances should be filled within two to three days maximum. Orders received while in an ongoing dialog or relationship with a customer will be fulfilled at a faster pace, possibly within less then a day.
GPL, Volunteer, or Non Paid work has a one to two week turn over, once again orders received in the midst of an ongoing customer relationship will be processed faster.
The time taken for additional models over the initial first one is around five hours, this is to give time for proper testing of the model and conversion into various formats along with other quality control checks on the model itself. Models that are derivatives of other models have a one to two hour turn over, with multiple self similar models or combination models (such as swords with a variety of styled hilts) have a half an hour to an hour turn over.
You never pay for labor, you only pay for the end result.
